Today, June 26, 2013 will be a day that is defined differently depending on whom you talk to. The Supreme Court struck down part of the Defense of Marriage Act and sent Proposition 8 back to the State of California essentially ruling that the people who appealed the California Supreme Court's ruling that it was unconstitutional had no legal standing to challenge that decision.
Here are the two official SCOTUS rulings:
DOMA: http://www.supremecourt.gov/opinions/12pdf/12-307_g2bh.pdf
Prop 8: http://www.supremecourt.gov/opinions/12pdf/12-144_8ok0.pdf
So, what do you think? Did the SCOTUS make the right decisions? Did it "legislate from the bench?" Did it open up any judicial cans of worms? Please share your thoughts below.

Hi All
ReplyDeleteI never thought a Federal law 'defining' marriage was a good idea (Thanks a lot Slick Willy) However, it WAS the law of the land. Zero decided - all by his lonesome - that he'd defy his OATH to uphold our laws and refused to defend it.
I felt cases like the one that brought the thing to SCOTUS were totally unfair. But the whole 'death tax' deal is unfair - and that's what it was all about...they did not strike down the whole law - just that part that dealt with FEDERAL taxes and benefits for legal spouses - of any flavor.
This does open the door (again) to force military preachers to perform these 'same-sex marriages' against their faith and conscience... There are plenty of churches out there who have NO problem with this BUT these 'activists' are all about making a point... and forcing THEIR wishes on others. That - IMO - is just plain WRONG.
As I've said all along - marriage is a STATES rights issue. In CA the 'boys' are all dressed up in their wedding gowns on the courthouse steps, claiming that the will of the people of that state has been overturned.
Back the truck up!! That is NOT what the SCOTUS ruling said. They SAID the parties who BROUGHT the case had no standing. In effect, they kicked it back to the LAST ruling - which was a STAY on the previous ruling. Gay 'marriage' in CA...is STILL BANNED.
Sooo they're back to square ONE at the STATE level... which is where it should be : )
With the DOMA ruling - one would think that 'all is right with the gay world'... not so. They're all over the tube claiming 'they're not done'...
IF (as the left says) We The People are becoming 'more open' to the gay 'cause'... why not just keep putting the issue on STATE ballots - and let The People decide if same-sex 'marriage' is right for them? Oh, that's right - they DID in 31 states, including CA!! The People said NO!
The answer is pretty simple...'they' want a federal law, legalizing gay 'marriage' and they will NOT be happy until that happens...
Bottom line: THAT has proven disastrous in countries where it has been done.
Leave it to the STATES!
